1. Scope of Application
1.1 These T&C apply to all contracts for the delivery of goods concluded between Bros & Gains Limited (hereinafter referred to as the “Seller”) and a consumer or entrepreneur (hereinafter referred to as the “Customer”) via the Seller’s online store. Deviating terms and conditions of the Customer will not be accepted unless the Seller expressly agrees to their application.
1.2 These T&C also apply to the purchase of gift vouchers unless expressly otherwise stipulated.
1.3 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
1.4 An entrepreneur is any natural or legal person or a legal partnership that acts in the exercise of their trade, business, or profession when entering into a legal transaction.
2. Conclusion of Contract
2.1 The presentation of products in the online store does not constitute a legally binding offer but an invitation to place an order.
2.2 The Customer submits a binding offer by completing the order process provided in the online store and clicking the “Buy Now” button.
2.3 The Seller may accept the Customer’s offer through one of the following actions:
- Sending a written order confirmation or confirmation in text form (e.g., email),
- Dispatching the ordered goods,
- Requesting payment after the order is placed.
2.4 If the Seller does not accept the offer within five days, the offer is deemed rejected.
2.5 The contract text is stored by the Seller and provided to the Customer after the conclusion of the contract in text form (e.g., email).
2.6 Before submitting the order, the Customer can review and correct their input.
2.7 The contract is concluded in the languages available in the online store.
2.8 Communication regarding order processing is conducted via email. The Customer must ensure that the provided email address is valid.
3. Right of Withdrawal
3.1 Consumers have a statutory right of withdrawal, which the Seller explains in the withdrawal policy.
3.2 The right of withdrawal does not apply to Customers residing outside the European Union.
4. Prices and Payment Terms
4.1 All prices are total prices. Any applicable shipping costs are listed separately.
4.2 Additional costs such as customs duties or fees may apply to deliveries outside the EU.
4.3 The available payment methods are displayed to the Customer during the order process.
4.4 Payments are processed through third-party providers such as PayPal, Klarna, or Stripe, depending on the selected method.
5. Delivery and Shipping Conditions
5.1 Delivery is made to the address specified by the Customer.
5.2 If delivery fails due to reasons attributable to the Customer, the Customer bears the additional costs.
5.3 The risk of accidental loss of the goods passes to the Customer upon handover to the shipping company.
5.4 Self-collection of goods is not possible.
5.5 Gift vouchers are provided via download or email.
6. Retention of Title
The goods remain the property of the Seller until full payment is received.
7. Liability for Defects (Warranty)
7.1 The statutory provisions apply unless otherwise stipulated.
7.2 For entrepreneurs, the warranty period for new goods is one year from delivery.
7.3 Obvious transport damages must be reported immediately.
8. Liability
8.1 The Seller is fully liable for damages caused by intent, gross negligence, or for damages arising from injury to life, body, or health.
8.2 In cases of slight negligence, the Seller is liable only for foreseeable, typical contractual damages.
8.3 Further claims of the Customer are excluded.
9. Special Conditions for Processing Goods According to Customer Specifications
9.1 The Customer must ensure that they possess the necessary rights to any submitted content.
9.2 The Seller reserves the right to reject orders if the provided content violates applicable laws.
10. Redeeming Gift Vouchers
10.1 Gift vouchers can only be redeemed in the online store and are valid until the end of the third year following their purchase.
10.2 Cash payouts are excluded.
10.3 Only one voucher may be redeemed per order.
11. Governing Law
The laws of Ireland apply, excluding the UN Convention on Contracts for the International Sale of Goods.
12. Alternative Dispute Resolution
The Seller is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
